29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Bluebird Medical Enterprises LLC, located at 1602 East Starr Avenue Ste. A, Nacogdoches, TX 75961: On or about December 9, 2020, and times thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear respirators while transporting suspected and confirmed positive COVID-19 patients.
