29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Between July 5, 2021 and August 28, 2021, employees who care for suspected or confirmed COVID-19 patients in the workplace were required to wear a N95 filtering facepiece respirators, including but not limited to 3M 1860 and 3M 8210, due to the presence of patients in the workplace who is positive for COVID-19 or display signs and symptoms of COVID-19. The employer failed to ensure a written respiratory program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was established and implemented.
