29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Unit Two South, 99 Mulford Road, Lafayette, NJ, 07848. The employer failed to provide medical evaluations for employees, including Licensed Practical Nurses (LPNs) and Certified Nursing Assistants (CNAs), required to wear N95 respirators and/or respirators labelled as KN95 while providing care for residents under investigation and/or confirmed as COVID-19 positive. Violation occurred on or about 4/28/2020 and thereafter.
