29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) At Inglemoor Rehabilitation and Care Center of Livingston, on or about April 23, 2020, and thereafter, where the use of respiratory protection, including but not limited to N95 respirators, was required for Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs) providing direct patient care and housekeeping staff providing support functions to patients who were positive for COVID-19, the employer did not ensure that initial fit testing was conducted. Abatement certification and documentation is required.
