29 CFR l 910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) CLR Carthage Center LLC DBA Carthage Center, located at 1045 West Street, Carthage, NY: The employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring its use. The employer required healthcare professionals, including but not limited to: Registered Nurses, Certified Nursing Assistants, Licensed Nursing Assistants, Physical Therapist, Occupational Therapist, Speech Therapist, Housekeeping and Maintenance Staff to wear respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 residents. The violation occurred on or about 1/15/2021 and after.
