29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Between July 5, 2021 and August 28, 2021, employee(s) are required to use N95 filtering facepiece respirators including but not limited to 3M 1860 and 3M 8210, due to the presence of patients in the workplace who is positive for COVID-19 or display signs and symptoms of COVID-19. The employer failed to provide a medical evaluation to determine the employee's ability to use a respirator before wearing a N95 filtering facepiece respirators in the workplace.
