29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): a) CLR Carthage Center LLC DBA Carthage Center, located at 1045 West Street, Carthage, NY: On or about 1/15/2021 and thereafter, the employer permitted the use of a N95 respirator after an employee failed the fit test and was not retested with other respirator make(s), model(s),or size(s) to assure a good fit. The employer required the employee[s]to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.
