29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator: a) Between July 5, 2021 and August 28, 2021, employee(s) are required to use N95 filtering facepiece respirators including but not limited to 3M 1860 and 3M 8210, due to the presence of patients in the workplace who is positive for COVID-19 or display signs and symptoms of COVID-19. The employer did not ensure employees required to wear a N95 filtering facepiece respirators when caring for suspected or confirmed COVID-19 patients were fit tested.
