29 CFR 1910.39(c)(2): The employer did not have a fire prevention plan which included procedures to control accumulations of flammable and combustible waste materials: (a) Oil Movements, Polymer Modified Asphalt Tank 113; On or about April 28, 2015 Calumet Superior, LLC. did not take necessary precautions to eliminate and/or control ignition sources such as, but not limited to, pyrophoric material and accumulation of Evaloy 4170 Polymer Resin within the tank and the vent/overflow line.
