29 CFR 1926.651(e): Exposure to falling loads. No employee shall be permitted underneath loads handled by lifting or digging equipment. Employees shall be required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials. Operators may remain in the cabs of vehicles being loaded or unloaded when the vehicles are equipped, in accordance with 1926.601(b)(6), to provide adequate protection for the operator during loading and unloading operations. On December 28, 2017, at the jobsite located at 5559 Anne Marie Dr., lot # 45, The employer did not provide a sufficiently rated protective system. (Plain Indifference). employees were exposed to an overhead struck-by hazard while working beneath a 1,177 pound trench shield which was suspended inside of the trench by the bucket of a hydraulic excavator. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
