29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmet. The employer is failing to protect employees from struck-by hazards associated with working in trenches and excavations. The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017. An employee was working inside a trench measuring approximately 20.5 feet deep X 45 feet long X 8 feet wide without a protective helmet. The employee was exposed to loose spoils and clumps of compacted soil that could fall from the edge of the excavation.
