29 CFR 1910.134(d)(1)(i): The employer shall select and provide an appropriate respirator based on the respiratory hazard(s) to which the worker is exposed and workplace and user factors that affect respirator performance and reliability. a) On or about March 12, 2020, the Department of Veteran Affairs DBA Richard L. Roudebush V.A. Medical Center had not selected an appropriate respirator to protect healthcare employees who had interactions with employees within the HIMS department. Employees were exposed to the hazard of Severe Acute Respiratory Syndrome Coronavirus-2 (COVID-19). b) On or about March 12, 2020, the Department of Veteran Affairs DBA Richard L. Roudebush V.A. Medical Center had not selected an appropriate respirator to protect healthcare employees performing COVID-19 screenings of visitors, patients, vendors, and employees (all assessments for triage) at all hospital entrances. Employees were exposed to the hazard of Severe Acute Respiratory Syndrome Coronavirus-2 (COVID-19).
