Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by hazards. (a) Kroskob Farms, LLC at 11491 CR 12, Fort Morgan, CO 80701: On or before July 6, 2021, the employer did not ensure that employees were protected from struck-by hazards. Employees did not wear helmets while operating Recreational Off-Highway Vehicles (ROHVs), including, but not limited to, a 2019 Polaris Ranger XP 900 EPS, while conducting daily job tasks such as checking water levels of pivot ponds. The employer provided protective helmets to employees who operated ROHVs; however, the employer did not require employees to wear the helmets provided. This condition exposed employees to serious head injury and even death caused from struck-by hazards while operating the vehicle(s). Abatement Note: Feasible and acceptable abatement methods include, but are not limited to: 1. Ensuring employees wear the proper helmet listed in the manufacturer's vehicle specific "Owner's Manual".
