29 CFR 1910.502(k)(1)(iii):All air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher, if compatible with the HVAC system(s). If MERV-13 or higher filters are not compatible with the HVAC system(s), employers must use filters with the highest compatible filtering efficiency for the HVAC system(s). VA Oakland Outpatient Clinic: Employees such as LVNs, Nurses, and Social Workers were exposed to health hazards related to SARS-CoV-2 virus because the employer did not ensure the use of air filters with minimum Minimum Efficiency Reporting Value (MERV) of 13 or higher in order to effectively trap small particles such as the coronavirus which is about 0.12 microns in size.
