29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit: a) 1045 West Parsonage Rd, Seabrook, NJ - Third Floor Cookline 3, batch kettle 3. An entry permit was not prepared where employee entered kettles 2 and 3 exposing them to struck-by and caught-in-between hazards. An employee suffered fatal injuries when conducting maintenance work in kettle 3 when the kettle energized, on or about September 19, 2022. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
