29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure, and which are in use by employees did not have approved ground fault circuit interrupters for personal protection: a. On or about 19 September 2023, at Pier #4, Cruises Terminal, San Juan, PR. Employees performing marine construction related activities standing inside the water from a working platform were working with an electrical tool connected with a defective/nonoperational ground-fault circuit interrupter. b. On or about 19 September 2023, at Pier #4, Cruises Terminal, San Juan, PR. Employees performing marine construction related activities were working with an electrical tool connected to a receptable at the end of the electrical cord not being protected with a ground-fault circuit interrupter. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
