Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to severe burn injuries from fire because conveying equipment did not have facilities to divert burning material to a safe dump area: a.) Particleboard Plant, Milling/Screening, 60-inch Conveyor - The 60-inch conveyor was placed into reverse by manipulating the conveyor's electrical wires in the motor control center. As a result, wood material that could potentially contain sparks, smolders, and/or embers was dumped onto the floor. These conditions existed on or about February 13, 2001. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with the requirements outlined in NFPA 664 ~ Standard for the Prevention of Fires and Explosion in Wood Processing and Woodworking Facilities. NFPA 664 Section 11-3.3.1 states that conveying equipment shall have facilities to divert burning material from the equipment downstream from the dryer to a safe dump area in the event of a fire in the dryer.
