Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to e mployees in that employees were exposed to a potential fall hazard: (a) In the e ast elevator at the McLaughlin, SD, facility for employees exposed to a potentia l fall hazard while riding the manual personnel hoist that was not equipped with fall protection. Among other methods, one feasible and acceptable abatement met hod to correct this hazard is to install safety railings or an equivalent fall p rotection system on the manual personnel hoist.
