29 CFR 1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and/or for preventing unauthorized personnel from attempting a rescue: (a) The employer failed to provide necessary rescue and emergency services for rescuing entrants from a permit required confined space. The facility relied on the Oregon, MO volunteer fire department for emergency and rescue services while permit required confined space entry procedures were conducted. The Oregon Fire Department had not been contacted by the employer and was not equipped to provide emergency rescue services to confined space entrants. This occurred at times such as: (1) On or about March 28, 2013 and March 30, 2013 employees entered the scrubber tower and were exposed to carbon monoxide, sulfur dioxide, oxygen deficiency, and fall hazards without necessary rescue and emergency services provided. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
