29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178: On August 25th, 2018 and at times prior, an employee was operating a rough terrain forklift without training and evaluation which resulted in a horizontal beam being lifted by the operator striking a mobile scaffold system and an employee sustaining fatal injuries in the vicinity of 72nd Avenue NW & 38th Street NW in Parshall, ND.
