29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) At the worksite, 22122 Freedom Drive, Champion NY - In the eastern side yard. On or about 4/20/2023, an open trench, approximately 6-7 feet deep, was being dug for the installation of a 4 inch daylight footer drain. The excavated material was placed within 2 feet of the edge of the trench exposing employees to the hazard of falling material.
