29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) At the worksite, 22122 Freedom Drive, Champion NY - In the eastern side yard. On or about 4/20/2023, a 6-7 foot trench was being dug for the installation of a 4 inch daylight footer drain. Employees in the trench were not protected from a cave-in by an adequate protective system exposing the employees to a trench collapse resulting in an employee fatality.
