29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) Diesel Fuel Platform: On or about October 29, 2018 and at times prior, employees were exposed to fall hazards of 6 feet 2 inches to the ground below while spraying diesel fuel into the semi-truck trailer. b) Asphalt Oil Heater Platform: On or about October 29, 2018 and at times prior, employees were exposed to fall hazards of 4 feet 10 inches to the ground below while performing maintenance operations from the Asphalt Oil Heater platform. c) Asphalt Silo: On or about October 29, 2018 and at times prior, employees were exposed to fall hazards in excess of 15 feet to the ground below while performing welding operations on the doors of the asphalt silo from the silo bin support structures.
