29 CFR 1926.1203(a): Before beginning work at a worksite, each employer must ensure that a competent person identifies all confined spaces in which one or more of the employees it directs may work, and identifies each space that is a permit space, through consideration and evaluation of the elements of that space, including testing as necessary. A) 133 East Clarke Place, Bronx NY: The employer did not ensure that a competent person evaluated all confined spaces where the employees may work, including the elevator pit, to determine that it was a permit space due to the stored energy from an elevator car above, on or before February 18th, 2021. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
