29 CFR 1910.147(c)(2): (i) If an energy isolated device in not capable of being locked out the employer's energy control program under paragraph (c)(1) of this section shall utilize a tagout system. a) 147 Quigley Blvd New Castle, DE: On or about February 1, 2022, the employer failed to ensure an orderly and safe shut down of Hamper Dumpers numbers 10 and 11 which had broken shut off switches prior to servicing it. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], stored energy [(d)(5)], and verification of isolation [(d)(6)], were not implemented to safeguard employees from the machine servicing hazards.
