29 CFR 1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill. On or about September 10, 2020 on the jobsite located at 777 Avenue Y, Bushton, Kansas, the employer failed to provide fall protection retraining for an employee that failed to identify and remove from service damaged fall protection equipment, such as damaged lanyards on the shock absorbers packs, which were torn and taped closed with duct tape, labels were not legible, and shock absorber packs had no legible expiration date, exposing the employee to fall hazards up to approximately 27 feet. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is complete.
