29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. As reference in 29 CFR 1926.103. Location: a) On the second floor of the jobsite at 126 Lafayette Street, New York, NY 10013: On or about March 7, 2023, employees were using handheld power chipping tools to chip into brick walls to demolish them while wearing N-95 respirators. The employer required the employees to use N-95 respirators while performing this task. The employer did not provide medical evaluations to determine the employee's ability to use a respirator.
