29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: Location: Mirion Technologies (Capintec), Inc., 7 Vreeland Road, Florham Park, NJ a) The employer did not establish and implement a written respiratory protection program for employees required to wear respirators such as, but not limited to, N95 and half mask respirators, in the spray paint booth while performing sanding, priming, cleaning and painting of shielding materials containing lead. On May 8, 2023, an employee sanding shielding materials in the machine room was exposed to respirable lead concentrations of 120 micrograms per cubic meter of air as an 8 hour Time Weighted Average exceeding the Permissible Exposure Limit (PEL) of 50 micrograms per cubic meter of air by 2.4 times. Zero exposure was assumed for the unsampled period of 66 minutes. The shielding material used contained 99.99 percent lead. Violation occurred on or about May 8, 2023.
