29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of the excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. The employer is failing to protect employees from struck-by and crushed-by hazards associated with trenching. This was most recently documented on December 20, 2017 at the jobsite located at or near 9750 East 53rd St N. in Bel Aire, Kansas. The employer did not ensure excavated or other materials were kept back at least 2 feet from the edge of the excavation to protect employees from struck-by and crushed-by hazard.
