29 CFR 1910.119(f)(1): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the safety information and which addresses the elements listed in 29 CFR 1910.119)f)(1)(I) through (f)(1)(v): a) The employer is failing to protect employees from fire/explosion hazards while preparing fireworks for display. This was most recently documented on July 3, 2018 at A.M. Pyrotechnics LLC, located at 2429 E. 535th Road in Buffalo, MO. The employer did not develop and implement written operating procedures for safely conducting activities in each covered process. 1)The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting e-matching operations of display firework devices consisting of Hazard Class/Division 1.3G explosives. 2) The employer did not develop and implement written operating procedures that provided clear instructions that address the limitation of electronic devices that are permitted in the e-matching area during work operations. 3) The employer did not develop and implement written operating procedures which provide clear instructions for the personnel and explosive limits permitted in the operating building. b) The employer is failing to protect employees from fire and explosion hazards. This was most recently documented on or about July 3, 2018 at A.M. Pyrotechnic Displays LLC, located at 2429 E. 535th Road, Buffalo, MO. 1) The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting various assembly operations of display firework devices, including but not limited to star rolling, comet pressing, and shell assembly, which consisted of Hazard Class/Division 1.3G and 1.4S explosives. 2) The employer did not develop and implement written operating procedures that provided clear instructions that address the limitation of electronic devices that are permitted in the assembly and processing areas during work operations. 3) The employer did not develop and implement written operating procedures that provided clear instructions for the personnel and explosive limits permitted in the operating building(s).
