29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. Location: In a trench located at the intersection of Farm Rd and Macy Rd in Briarcliff Manor, NY 10510 a) On or about November 20th, 2019, the competent person on-site did not remove the two employees from situation that could result in possible cave-in - two employees were inside an approximate 7ft trench by 5ft wide and 12ft long with vertical earth walls that were wet which added more weight.
