29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. The employer is failing to protect employees from caught-under and crushing hazards associated with operating an all-terrain forklift (Caterpillar Model TL1255D, Serial # ML702775) over uneven ground. The most recent occurrence was documented on September 23, 2020 on the jobsite located at (40.53406 -95.45267), associated with the worksite of 30325 State Highway C, Westboro, MO; where the employer has the equipment operator backing sideways along the slope of an agricultural terrace. The limited maneuverability led to the forklift tipping over resulting in the operator being ejected from the cab, struck then pinned under the truck where by suffering fatal injuries.
