Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical farm to employees in that employees were exposed to the recognized fire and explosion hazards associated with the presence of ignition sources in a dusty environment. Employees at the feed yard facility are exposed to fire/explosion hazards due to the use of a spark-producing steel scraper to clean the inside of the corn and the soy meal bins. General precautions for dusty environments identified in National Fire Protection Association (NFPA) 63 -1971 include the elimination of all sources of ignition because many dusts may be ignited by very low energy sparks. Among other methods, feasible and acceptable abatement methods to correct his hazard include, but are not necessarily limited ot the following: a)Use a scraper/shovel made of a non-spark producing material in accordance with NFPA 61C - 1973. Abatement certification is required for this violation. The abatement certification sheet is enclosed with the citations.
