29 CFR 1910.1027(f)(1)(i): The employer did not implement engineering and work practice controls to reduce and maintain employee exposure to cadmium at or below the permissible exposure limit (PEL): (a) The employer failed to provide adequate engineering and work practice controls to reduce or minimize employee exposure to cadmium at or below the permissible exposure limit (PEL); (1) On or about May 16, 2013, a Battery Break employee operating the skid steer was exposed to an 8-hour time weighted average (TWA) level of 8.83 ug/m3 of cadmium, which is 1.77 times the OSHA permissible exposure level (PEL) of 5 ug/m3. (2) On or about May 16, 2013, a Battery Break employee at the lower saw location was exposed to an 8-hour time weighted average (TWA) level of 9.54 ug/m3 of cadmium, which is 1.91 times the OSHA permissible exposure level (PEL) of 5 ug/m3. (3) On or about May 16, 2013, the charge floor employee was exposed to an 8-hour time weighted average (TWA) level of 20.75 ug/m3 of cadmium, which is 4.15 times the OSHA permissible exposure level (PEL) of 5 ug/m3. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
