29 CFR 1910.1030(f)(3)(ii)(A): The source individual's blood shall be tested as soon as feasible and after consent is obtained in order to determine HBV and HIV infectivity. If consent is not obtained, the employer shall establish that legally required consent cannot be obtained. When the source individual's consent is not required by law, the source individual's blood, if available, shall be tested and the results documented. (a) Facility: On or about February 2, 2023, an employee suffered a needlestick injury to the palm of the right hand from an IV needle that had been used in the treatment of a patient and placed in a cup on a tray by a dentist. The employer did not test the source individual's blood in a reasonable period and did not establish that legally required consent could not be obtained.
