29 CFR 1910.1027(l)(1)(i)(A): The employer did not institute a medical surveillance program for all employees who were or potentially were exposed to cadmium at or above the action level on 30 or more days per year (twelve consecutive months): (a) A cadmium medical surveillance program was not instituted for all employees who were or potentially were exposed to cadmium at or above the OSHA action level of 2.5 ug/m3 on 30 or more days per year (twelve consecutive months); (1) On or about May 16, 2013, a battery break employee operating the skid steer was exposed to an 8-hour time weighted average (TWA) level of 8.83 ug/m3 of cadmium, which is 1.77 times the OSHA permissible exposure level (PEL) of 5 ug/m3. The battery break employee was not included in a cadmium medical surveillance program. (2) On or about May 16, 2013, a battery break employee at the lower saw location was exposed to an 8 hour time weighted average (TWA) level of 9.54 ug/m3 of cadmium, which is 1.91 times the OSHA permissible exposure level (PEL) of 5 ug/m3. The battery break employee was not included in a cadmium medical surveillance program. (3) On or about May 16, 2013, the charge floor employee was exposed to an 8-hour time weighted average (TWA) level of 20.75 ug/m3 of cadmium, which is 4.15 times the OSHA permissible exposure level (PEL) of 5 ug/m3. The charge floor employee was not included in a cadmium medical surveillance program. (4) On or about May 16, 2013, a casting employee was exposed to an 8-hour time weighted average (TWA) level of 2.76 ug/m3 of cadmium when skimming kettles, which is 1.1 times the OSHA action level of 2.5 ug/m3. The casting employee was not included in a cadmium medical surveillance program. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
