29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. a) On or about November 8, 2023 and at prior times, in the blending tank area at Sound Resource Solutions facility located in Sheperd, TX, employees were exposed to respiratory hazards when they used 3M M7502 half face respirators for mixing, blending and transferring of chemicals in the employer's process for making its 2012 material without being medically evaluated to determine their ability to use respirators.
