29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about January 30, 2018, employees are required to operate forklifts to move material and products such as tanks throughout the facility without being trained by the employer, exposing employees to hazards such as, but not limited to being struck by falling tanks and/or crushed by the forklift in the event of a tip over. On or about March 23, 2018, employees were operating the Hyster Model H360XL forklift to transport tanks. The operator could not see around the tanks, exposing employees to the hazard of being struck by the forklift.
