Text For Citation: 02 Item/Group: 001 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer is failing to protect employees from fall and struck-by hazards associated with employees riding in the bucket of an excavator on a construction jobsite. The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017 where the employer was lifting and transporting employees in the bucket of a John Deere 350G LC excavator as a means of access and egress for a 20.5 foot deep excavation.
