29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. On or about April 22, 2020, the employer did not record work-related illnesses of employees who had occupational exposure to the SARS-CoV-2 virus, which causes COVID-19 when the cases met the criteria for recording: a. A Certified Nursing Assistant (CNA) was hospitalized from on or about April 23, 2020 to April 29, 2020, resulting in at least 6 days away from work. b. A Licensed Practical Nurse (LPN) was hospitalized from on or about April 22, 2020 to April 27, 2020, resulting in at least 5 days away from work. Abatement documentation is required of this item in accordance with 29 CFR 1903.19(d).
