29 CFR 1926.651(k)(2): Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) On June 15, 2016, employees were not removed from cave-in hazards in that employees were instructed to enter the 60 feet long and 12 feet deep trench to remove the fill dirt near the house located at 463 Claxton Glenn Ct after a cave-in occurred. b) On June 15, 2016, at 463 Claxton Glenn Ct., there was no precaution taken before the employees were instructed to enter the 60 feet long - 12 feet deep trench near the driveway to complete the installation of the sewer pipe. The trench collapsed trapping an employee under over 8 feet of fill dirt.
