29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: DeCosta Enterprises Inc, and Fabricio DeCosta does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 5/19/2020, at 10 Braeburn Court, Mahwah, NJ, at instance (a): Exterior Framing- where employees were engaged in wood framing activities and were exposed to fall hazards of approximately 15 feet while installing wood trusses near the exterior edge without any method of fall protection. To abate this violation the employer must ensure that its employees performing framing work are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 foot or more without adequate fall protection. DeCosta Enterprises Inc was previously cited for repeat violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 501 (b)(13), which was contained in OSHA Inspection Number 1398036 and 1443478. In regards to Inspection Number 1398036, Citation #01, Item # 001, was issued on 05/20/2019 to a workplace located at 22 Rocksbury Road, Mahwah NJ 07430. This citation became a final order on 06/19/2019 (DCAT). In regards to Inspection Number 1443478, Citation # 02, Item # 02, was issued on 12/18/2019 to a work place located at 26 Dogleg Lane, Lawrenceville NJ 08648. This citation became a final order on 01/29/2020 (DCAT).
