29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident: a) Clearview Operating Co., LLC dba The Grand Rehabilitation and Nursing, Queens, 157-15 19th Avenue, Whitestone, New York: On or about April 29, 2020, and continuing thereafter, the employer did not report to OSHA the work-related fatality of a Rehab CNA within eight (8) hours after being notified by the employee's family member that the employee had died of COVID-19. OSHA was notified of the fatality by the Centers for Medicare and Medicaid Services (CMS) on July 10, 2020.
