29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching and excavations. The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017. Employees were performing work on a sanitary sewer within an trench measuring approximately 20.5 feet deep X 45 feet long X 8 feet wide. The protective system used by the employer was not adequately installed and exceeded the manufacturer's requirements. An employee was injured in this trench due to a trench collapse on December 31, 2019, and later that same day, the employer allowed another employee to enter the same trench without taking appropriate measures to ensure safety.
