29 CFR 1926.1053(b)(13): The top or top step of a stepladder shall not be used as a step. a. Located at the job site at 318-322 Lenell Loop - Building 43, Delaware, Ohio: On or about December 15, 2021, two employees were observed performing framing activities utilizing pneumatic nail guns from the top step of portable ladders, thereby exposing them to fall hazards. Perez Construction LLC was previously cited for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1477523, citation number 1, item number 2, and was affirmed as a final order on July 24, 2020, with respect to a workplace located at 824 Forest Edge Court, Lot 7219, Marysville, Ohio.
