Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inhalation hazards from overexposures to dust and ammonia: At the establishment - Employee exposure to air contaminants exceeded the permissible levels set forth by the American Conference of Governmental Industrial Hygienists (ACGIH). In the following instances, employees performing the job tasks listed below were exposed to dust in excess of the Threshold Limit Value (TLV) of 10 mg/M3 (milligrams per cubic meter of air) as an eight hour time weighted average (8 hr TWA) as established by the American Conference of Governmental Industrial Hygienists (ACGIH 1987-88). For any sampling period listed below less than 480 minutes (8 hours), the calculation of the TWA assumes zero exposure for the balance of the time unsampled. a)Breeder Barn #2, Poland, ME. (1/26/96) - Cleaning Crew employee performing cleaning (blowdown) of barn using compressed air was exposed to elevated levels of dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 348.00 mg/M3 for a 502 min. sampling period. Employee exposure level was 34 times the TLV. b)Barn #30, (2/22/96) - Bird Crew employee pulling fowl was exposed to elevated levels of dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 1,747.00 mg/M3 for a 315 min. sampling period. Employee exposure level was 175 times the TLV. c)Barn #80 (2/27/96) - Sanitation Crew employee removing manure from deep pit barn via bucket loader was exposed to elevated levels of dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 78.00 mg/M3 for a 529 min. sampling period. Employee exposure level was 8 times the TLV. d)Barn #80 (2/27/96) - Sanitation Crew employee removing manure from deep pit barn via bucket loader was exposed to elevated levels of dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 87.00 mg/M3 for a 525 min. sampling period. Employee exposure level was 9 times the TLV. e)Brooder Barn #1 and Barn #30, (3/12/96) - Bird Crew employee pulling fowl and stuffing pullets was exposed to elevated levels of dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 31.00 mg/M3 for a 338 min. sampling period. TWA) was equal to 50.20 mg/M3 for a 337 min. sampling period. employee exposure level was 5 times the TLV. g)Barn #40 and Barn #43, (3/14/96) - Bird Crew employee stuffing pullets was exposed to elevated levels of dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 101.10 mg/M3 for a 435 min. sampling period. Employee exposure was 10 times the TLV. h)Barn #40 and Barn #43, (3/14/96) - Bird Crew employee stuffing pullets was exposed to elevated levels of to dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 44.64 mg/M3 for a 338 min. sampling period. Employee exposure level was 4.4 times the TLV. In addition, the following employees were exposed to Respirable Dust in excess of the ACGIH Threshold Limit Value of 3 mg/M3 as an eight hour time weighted average (8 hr TWA). i)Barn #30, (2/22/96) - Bird Crew employee pulling fowl was exposed to elevated levels of respirable dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 11.84 mg/M3 for a 555 min. sampling period. Employee exposure was 3.9 times the TLV. j)Brooder Barn #1 and Barn #30, (3/12/96) - Bird Crew employee pulling fowl and stuffing pullets was exposed to elevated levels of respirable dust. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 10.50 mg/M3 for a 340 min. sampling period. Employee exposure was 3.5 times the TLV. In the following instances, the employees performing the job tasks listed below were exposed to ammonia in excess of the Threshold Limit Value of 25 ppm (parts per million) as an eight hour time weighted average (8 hr TWA) as established by the American Conference of Governmental Industrial Hygienists (ACGIH 1983-1984). In one instance (See Instance V, below), a Bird Crew employee was exposed to ammonia in excess of 50 ppm as an 8 hr. TWA as established by the Occupational Safety and Health Administration (OSHA). k)Plant #8 Barns, (2/1/96) - Barn Crew employee performing daily maintenance was exposed to elevated levels of ammonia. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 49.3 ppm. for a 451 min. sampling period. Employee exposure was 1.9 times the TLV. l)Plant #8 Barns, (2/1/96) - Barn Crew employee performing daily maintenance was exposed to elevated levels of ammonia. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 45.0 ppm. for a 458 min. sampling period. Employee exposure was 1.8 times the TLV. m)Plant #8 Barns, (2/1/96) - Barn Crew employee performing daily maintenance was exposed to elevated levels of toammonia. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 39.4 ppm. for a 464 min. sampling period. Employee exposure was 1.5 times the TLV. n)Plant #8 Barns, (3/6/96) - Barn Crew employee performing daily maintenance was exposed to elevated levels of ammonia. The employees' measured eight hour time weighted average (8 hr. TWA) was equal to 38.8 ppm. for a 488 min. sampling period. Employee exposure was 1.5 times the TLV. o)Plant #8 Barns, (3/6/96) - Barn Crew employee performing daily maintenance was exposed to elevated levels of ammonia.
