Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical hazards to the eyes, face, and hands: a)Breeder Barn #2, Poland, ME. (1/29/96) - Cleaning Crew employee performing disinfecting of barn with DC&R Brand disinfectant containing formaldehyde via power sprayer was not wearing eye or face protection. b)Hatchery Compressor/Generator Room (2/21/96) - An employee dispensing corrosive Biosentry Brand Biophene disinfectant with a pH of 12.3 (from MSDS) from secondary container into a water compressor was not wearing eye or face protection. c)Hatchery Stock/Wash Room (5/9/96) - An employee dispensing corrosive Magna Q 43 Brand disinfectant with a pH of 13.0 (from MSDS) into secondary container and finally into washer was not wearing eye or face protection. Employee stated to Compliance Officer that previously used liquid (Biophene) when splashed on clothes or skin would burn. d)Barn 23 (5/17/96) - An employee dispensing and applying Permethrin Brand fly spray via gas powered sprayer was not wearing eye or face protection. e)Feed Mill, (1/23/96) - Employees handling and dispensing feed, trace minerals (eg.selenium) and larvicide had not been furnished with gloves by the Employer. f)Plant #8 - On or around 2/28/96 Liquid Metal Brightener A, a phosphoric and nitric acid solution, was poured into the egg washing machine without the use of protective gloves. Among other methods, one feasible and acceptable method to reduce or eliminate employee exposure includes, but is not necessarily limited to provide employees appropriate eye, face, and hand protection in sufficient quantities and sizes.
