29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178: 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): The employer does not provide training and evaluate employees operating the Terex TH844C Turbo all terrain forklift. a) This most recently occurred on or about February 15, 2022, at 19 Terra Vita Ct., South Barrington, Illinois 60010. The employer does not train and evaluate employee(s) operating the Terex TH844C Turbo all terrain forklift. Emerald Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(l)(1)(i), which was contained in OSHA inspection number 1525494, citation number 1, item number 1 and was affirmed as a final order on November 4, 2021, with respect to a workplace located at 751 Meacham Rd. Elk Grove Village, IL 60007. To abate this hazard in the future, the employer must ensure to provide training and evaluate employee(s) operating the all terrain forklifts. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.
