29 CFR 1910.178(l)(4)(iii):An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) Warehouse: Employees were exposed to struck-by hazards in that employees were allowed to operate powered industrial trucks including, but not limited to a Crown Standup Forklift Model 4500-60, Serial Number 10000829 without the employer ensuring that the operators had received the required evaluation at least once every three years as specified in the regulation. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
