29 CFR 1926.1053(b)(13): The top step of a stepladder is used as a step: a) The employer fails to ensure effective protection against falls while employees use the top step of a 6 foot A-frame ladder to gain access to the top of framed walls as required by the standard, as demonstrated on or about August 21, 2019, at 1947 and 1955 Boxwood Way, Lot 138 /139 Creekstone, Opelika, Alabama Way, Lot 139 Creekstone, Opelika, Alabama, when employees are using the top step of an A-frame ladder, are exposed to a fall hazard of up to 9 feet 6 inches to the floor below. Jaime Martinez, dba Jaime Martinez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(13), which was contained in OSHA inspection number 1349562, citation number 1, item number 1b and was affirmed as a final order on February 2, 2019, with respect to a workplace located at 888 West Richland circle, Lot 32 West Richland Subdivision, Auburn, Alabama 36832.
